1. Introduction
Welcome to OBD2 Center File Tuning, operated by Obd2Center Limited ("Obd2Center", "we", "us", "our").
These Terms of Service govern your access to and use of https://app.obd2-center.net (the "Platform"), including ECU and TCU file tuning, file uploads, technical file analysis, modified file downloads, account balance top-ups, payments and customer support.
By creating an account, topping up your balance, submitting a tuning request, purchasing a file service or otherwise using the Platform, you agree to these Terms.
If you do not agree to these Terms, do not use the Platform.
2. Eligibility and account registration
You must be legally capable of entering into a binding agreement to use the Platform.
When registering, you agree to:
— Provide accurate registration and contact information.
— Keep your login credentials secure.
— Protect your account against unauthorised access.
— Notify us if you suspect unauthorised use of your account.
— Ensure that your use of the Platform complies with applicable laws.
An account is personal to the holder. You are responsible for everything done through your account, including orders placed and balance spent.
We may suspend or restrict accounts involved in fraud, unlawful activity, security violations or material breaches of these Terms.
3. Our services
The Platform provides automotive electronic control unit (ECU) and transmission control unit (TCU) file services, which may include:
— Original ECU and TCU file uploads.
— File identification and technical analysis.
— ECU and TCU calibration and tuning.
— Performance and drivability modifications.
— File corrections and related technical services.
— Modified file downloads.
— Order history and technical support.
The availability of a particular service depends on the vehicle, control unit, software version, file format, requested modification and technical information supplied.
We may update or introduce additional services as the Platform develops.
4. Customer responsibilities
You are responsible for ensuring that:
1. You have the right and authority to submit each file.
2. Vehicle and ECU/TCU information supplied with an order is accurate.
3. You have any necessary permission from the vehicle owner or rights holder.
4. Your requested modification is lawful in the jurisdiction where the vehicle will be used.
5. The original file is complete and suitable for the requested service.
6. The delivered file is checked for compatibility before installation.
7. Installation and testing are performed using suitable equipment and procedures.
You must not upload malicious files, stolen confidential information or files you are not authorised to submit.
You must not use the Platform to facilitate fraud, vehicle theft, unauthorised access or unlawful tampering with safety or emissions systems.
5. ECU and TCU file tuning
Different vehicles and control units may use different hardware, software versions, calibration identifiers and configurations.
A modified file suitable for one control unit may not be suitable for another.
You must verify that a delivered file matches the intended vehicle and control unit before programming it.
Unless expressly agreed otherwise, the file service does not include physical installation, vehicle repairs, independent dyno testing, road testing or verification of the entire vehicle.
We may decline or cancel a request if the supplied information is insufficient, the file is corrupted, the requested work is unlawful or the requested modification cannot reasonably be completed.
Where practicable, we will explain any material technical limitations or additional requirements.
6. Safety and emissions compliance
All services must be used for lawful purposes.
You must not request or use modifications intended to defeat legally required emissions controls, unlawfully disable mandatory safety systems, conceal regulatory non-compliance or facilitate fraud.
Certain modifications may affect roadworthiness, emissions compliance, vehicle registration, insurance, manufacturer warranties or suitability for public-road use.
You are responsible for checking the applicable legal requirements before using a modified file.
We reserve the right to refuse any request that would violate applicable law.
7. File uploads and downloads
You authorise us to access and process submitted files as reasonably necessary to provide the requested service.
You retain ownership of original files you own, subject to applicable third-party rights.
You grant Obd2Center Limited a limited, non-exclusive authorisation to store, inspect, process, modify and transmit submitted files as necessary to fulfil your order, provide support, maintain security and comply with legal obligations.
Uploading a file does not transfer its ownership to us.
Download links may expire, and files may be subject to storage limits or retention periods disclosed by the Platform.
You should download and securely back up your files after delivery. Unless expressly agreed otherwise, the Platform is not intended to be your permanent file archive.
We use reasonable security measures to protect submitted files but cannot guarantee uninterrupted availability or indefinite storage.
8. Intellectual property
The Platform, including its software, branding, design, documentation and original content, is owned by or licensed to Obd2Center Limited and is protected by applicable intellectual property laws.
You may not copy, reproduce, reverse engineer or commercially exploit the Platform without authorisation, except where permitted by law.
You retain rights you already hold in the files you submit.
Your rights to a modified file depend on ownership of the underlying material, applicable intellectual property rights and any specific agreement relating to the service.
Payment for a tuning service does not automatically transfer ownership of manufacturer software or third-party intellectual property.
Unless otherwise agreed, delivered files are provided for the lawful, intended application for which they were supplied. You must not redistribute or resell them where doing so would infringe intellectual property rights or breach an applicable agreement.
9. Prices, account balance and payments
All prices and balances on the Platform are stated and charged in United States dollars (USD).
Each file service is priced individually. The price applicable to your order is shown before you confirm it, and the price agreed at that moment applies to that order even if our price list changes later.
The Platform works with a prepaid account balance:
— You top up your balance, and the cost of each file service is deducted from it at the moment the service is delivered.
— You may also pay for a single file service directly, without topping up first.
— A top-up is a prepayment for future services on the Platform. It is not a deposit, it earns no interest, and it is held as credit against your account rather than as money held on your behalf.
— Your balance can be spent only on services offered by the Platform. It cannot be transferred to another account.
— If your balance is lower than the price of a service, the order cannot be placed until you top the balance up. The Platform does not deliver services on credit.
Payments are processed by a third-party payment provider. Payment transactions may be subject to that provider's own terms and privacy policy. We may delay processing an order until the provider has confirmed the payment.
A balance is credited when the payment provider confirms the payment to us, not when you are redirected back from the payment page.
You must not use stolen payment credentials, engage in payment fraud or attempt to obtain services without paying the applicable fees.
If a payment is duplicated, incorrectly charged or not properly reflected against your balance or an order, contact our support team for investigation.
10. Bonus credit
From time to time we may add bonus credit to your balance when a payment reaches a published amount. Where bonus credit is offered, the amount and the qualifying thresholds are shown on the Platform at the time of payment.
Bonus credit is a promotional benefit, not money you have paid us. Accordingly:
— It can be spent only on services offered by the Platform.
— It cannot be withdrawn, cashed out, transferred or refunded as money.
— It is credited to the same balance as your own funds and, unless stated otherwise, is spent together with them.
— If the payment that earned the bonus is later refunded or reversed, we will remove a proportionate share of that bonus from your balance at the same time. Only the share corresponding to the refunded amount is removed, and never more than the bonus originally granted.
We may change or withdraw a bonus offer for future payments at any time. A change does not affect bonus credit already granted on a completed payment.
11. Delivery of files and your right to cancel
File services are digital and are delivered to your account as soon as they are produced, which is usually immediately.
By confirming an order you ask us to begin performing the service straight away and you accept that, once the modified file has been produced and made available to you, the service has been fully performed and a cancellation right that depends on the service not yet being performed no longer applies.
This does not affect any remedy you have if the file is defective, nor any consumer right that cannot lawfully be excluded.
12. Cancellations and refunds
Refunds and cancellations are assessed according to the circumstances of the order, the stage of processing, the nature of the service and applicable law.
The following principles apply:
— Before processing begins: a cancellation or refund may be available, subject to applicable law and any clearly disclosed cancellation conditions.
— After the file has been produced: refund eligibility depends on the work completed, the agreement for the service and applicable legal requirements.
— Service cannot be completed: if we cannot provide the service you paid for, we will consider an appropriate refund or other remedy.
— Verified file defect: if a delivered file has a verified defect attributable to our work, contact us with your order reference and technical details so we can investigate and determine an appropriate correction or remedy.
— Customer-supplied errors: incorrect vehicle details, incompatible control units, corrupted original files, unauthorised file alterations and installation errors may affect the availability of a refund or correction.
A refund request should include the order reference, payment details sufficient to identify the transaction and a description of the issue. We may request reasonable technical evidence to investigate a claim.
When a payment is refunded or reversed, the refunded amount and any proportionate bonus share are deducted from your account balance.
Nothing in these Terms excludes a refund, cancellation right, consumer guarantee or other remedy that cannot lawfully be excluded.
Customers may contact us to resolve payment issues. This does not restrict their legal right to raise a payment dispute with their payment provider, although we ask you to contact us first so that we can look into it.
13. Vehicle performance and results
Unless expressly agreed in writing, we do not guarantee a specific increase in horsepower, torque, fuel economy, acceleration or other performance result.
Actual results depend on vehicle condition, hardware, fuel quality, maintenance, installation, operating conditions and other factors.
Tuning may affect component wear, engine temperatures, drivetrain stress, reliability, emissions and manufacturer warranties.
Performance estimates are not guarantees of actual results.
14. Installation and technical verification
Modified files should be installed by a suitably qualified professional using compatible programming equipment and appropriate procedures.
Before programming, you should:
— Confirm the ECU/TCU hardware and software identification.
— Verify the file matches the intended application.
— Keep a verified backup of the original file.
— Use an appropriate stable power supply.
— Follow the programming equipment manufacturer's instructions.
— Confirm the vehicle and control unit are suitable for the procedure.
Incorrect programming may cause a vehicle not to start, control-unit failure, loss of functionality or other damage.
Do not install a file if its compatibility or integrity is uncertain.
15. Third-party services
The Platform may rely on third-party hosting providers, payment processors, technical service providers and other external services.
Third-party services may have separate terms and warranties.
We are not responsible for independent third-party services to the extent permitted by law. This does not exclude responsibility for our own services or obligations that cannot lawfully be excluded.
Vehicle manufacturer names and trademarks are used where necessary to identify relevant vehicles and control units. Unless expressly stated, we do not claim affiliation with vehicle manufacturers.
16. Platform availability and security
We aim to maintain a reliable and secure Platform but do not guarantee uninterrupted access or error-free operation.
Maintenance, infrastructure failures, security incidents, third-party outages and other circumstances may temporarily affect availability.
We may suspend access where reasonably necessary to protect the Platform, customer accounts, files or systems.
We will take reasonable steps to restore affected services where practicable.
17. Prohibited activities
You must not:
— Use the Platform for unlawful purposes.
— Upload malicious files or compromise our systems.
— Access another customer's account or files without authorisation.
— Circumvent payment controls or security restrictions.
— Obtain or spend balance or bonus credit by fraud, error or manipulation.
— Submit files that infringe third-party rights.
— Misrepresent your identity or authority.
— Request unlawful disabling of safety or emissions controls.
— Redistribute or resell services in violation of an agreement.
— Interfere with the Platform or other customers' access.
We may investigate suspected violations and suspend or terminate access where justified.
18. Disclaimer of warranties
We will provide our services with the care and skill required by applicable law.
Except for express commitments and warranties that cannot lawfully be excluded, we do not guarantee that every submitted file can be modified, that every delivered file will work with every vehicle or that every requested result can be achieved.
Nothing in these Terms removes mandatory consumer rights or remedies.
19. Limitation of liability
To the extent permitted by applicable law, we are not responsible for losses caused by incorrect information supplied by a customer, incompatible hardware, unauthorised alterations, improper installation, misuse of a file or failure to follow appropriate technical procedures.
Subject to applicable law, we are not liable for indirect or consequential losses that were not reasonably foreseeable when the service was agreed.
Where permitted by law, our total liability for a particular paid file service will not exceed the amount paid for that service in the transaction giving rise to the claim.
These limitations do not apply to liability that cannot lawfully be limited, including liability where exclusion is prohibited by law.
Nothing in this section excludes mandatory consumer rights or remedies.
20. Indemnity
To the extent permitted by law, you are responsible for losses and reasonable costs arising from your unlawful use of the Platform, infringement of third-party rights or material breach of these Terms.
This provision does not require you to indemnify us for losses caused by our own unlawful conduct or where such an allocation of responsibility is prohibited by law.
21. Suspension and termination
You may stop using the Platform at any time and may request account closure by contacting our support team.
We may suspend or terminate access where reasonably necessary because of fraud, unlawful activity, security risks or a material breach of these Terms.
Where practicable, we will provide notice and an opportunity to resolve the issue.
Bonus credit is not paid out on closure.
Account closure does not automatically eliminate outstanding payment obligations, lawful record-retention requirements or rights arising from completed transactions.
22. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, store and disclose personal information.
Our Privacy Policy forms part of the information governing your use of the Platform.
23. Changes to these Terms
We may update these Terms to reflect changes in our services, business operations, security requirements or applicable law.
The updated version will be published on the Platform with a revised date.
Where required by law, we will provide notice or obtain consent before implementing material changes.
Changes will not remove rights that have already accrued or retroactively alter a completed transaction where doing so would violate applicable law.
24. Governing law and disputes
These Terms are governed by the laws of Kenya, except where mandatory laws in another jurisdiction apply.
If a dispute arises, the parties should first attempt to resolve it through good-faith communication.
If the dispute cannot be resolved informally, either party may pursue available remedies before a court or other competent body with jurisdiction.
Nothing in this section removes a consumer's mandatory legal rights.
25. General provisions
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Our failure to enforce a provision immediately does not waive our right to enforce it later.
These Terms, together with any service-specific conditions clearly disclosed and accepted during an order, govern your use of the Platform.
